These Terms of Service (“Terms”) govern all services provided by NorCal Aerial Image (“Company,” “we,” “our,” or “us”) to our clients (“Client,” “you,” or “your”). By booking or using our services, you agree to these Terms.
1. Services Provided
We offer aerial photography, videography, mapping, inspection imagery, and related services as outlined in your project agreement or invoice. All work is performed in compliance with FAA regulations, applicable local laws, and safety guidelines.
2. Scheduling & Cancellations
Projects are scheduled based on availability and weather conditions.
Cancellations or rescheduling require at least 48 hours’ notice.
Cancellations made within 48 hours of the scheduled shoot may incur a cancellation fee of up to 50% of the project total.
Weather-related postponements will be rescheduled at no additional cost.
3. Payment Terms
Payment terms will be outlined in your invoice or service agreement.
Unless otherwise agreed, a deposit may be required to secure your booking, with the balance due upon delivery of final files.
Late payments may incur a 5% late fee per 30 days past due.
4. Deliverables & File Access
Final deliverables will be provided in the formats agreed upon in advance.
Files will be delivered via password-protected gallery, download link, or other secure method.
Client is responsible for downloading and securely storing files; we do not guarantee indefinite storage unless specified in writing.
5. Licensing & Usage Rights
Unless otherwise stated in writing, all content is licensed, not sold.
Licensing terms will be specified in your project agreement or invoice.
Content may not be resold, transferred, or sublicensed without written permission from NorCal Aerial Image.

6. Client Responsibilities
Client must secure all necessary permissions to photograph/film the property or location, including property owner consent and any required permits.
Client must inform us of any safety hazards, flight restrictions, or access limitations prior to the scheduled shoot.
7. Limitation of Liability
We are not liable for:
Delays or inability to perform due to weather, airspace restrictions, or conditions beyond our control.
Loss of revenue or other consequential damages resulting from the use or inability to use the deliverables.
Any claims arising from the use of content outside the licensed terms.
8. Governing Law
These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Contra Costa County, California.
9. Acceptance of Terms
By booking or using our services, you acknowledge that you have read, understood, and agreed to these Terms of Service.

1. Copyright Ownership
All photographs, videos, maps, and other creative works produced by NorCal Aerial Image (“Company,” “we,” “our”) are protected by United States and international copyright laws.
Unless otherwise agreed in writing, the Company retains full copyright ownership of all original works created.
2. Client Project Licensing
For commissioned projects, the Client is granted a non-exclusive, non-transferable license to use the delivered content for the purposes specified in their project agreement or invoice.
Permitted Uses: Marketing, advertising, internal documentation, social media, print, and web use related to the Client’s business or project.
Prohibited Uses: Reselling, relicensing, sublicensing, or using the content for any purpose other than what was agreed in writing.
Licenses do not grant ownership of the content and do not include raw, unedited files unless explicitly stated in the agreement.
3. Stock Image & Video Licensing
Images and videos purchased through our online store are licensed under one of the following:
Royalty-Free Commercial License – For marketing, advertising, editorial, or other approved commercial purposes.
Editorial License – For non-commercial, newsworthy, or educational purposes only.
Licensing terms, permitted uses, and restrictions are outlined on the product page and at checkout.
4. Attribution
Attribution (“Photo/Video by NorCal Aerial Image”) is not required for licensed commercial use but is appreciated when possible, especially for editorial use.
5. Unauthorized Use
Unauthorized reproduction, resale, distribution, or public display of our content without a valid license or written permission is prohibited and may result in legal action.

While NorCal Aerial Image is capable of aerial data collection, visitors should understand that we do not interpret survey-grade information or provide surveying, engineering, or inspection services.
For projects where exact measurements are required, you must rely on a licensed land surveyor or survey engineer. Our data gathering services can support your surveyor, but they do not replace the need for a licensed land surveyor in any state. This is standard across the industry — no drone data collection service can legally interpret survey-grade data without a surveyor on staff.
Additionally:
We do not overlay property boundaries on home lots (developed or undeveloped).
We do not guarantee absolute accuracy for legal or engineering purposes.
